Planned removal of entries from GB Article 95 list

Under the Great Britain Biocidal Products Regulation (GB BPR) Great Britain maintains its own independent list of biocidal active substance suppliers, referred to as the GB Article 95 List. 

Biocidal active substance and product suppliers included on the EU Article 95 List under the BPR (EU) No. 528/2012 at the end of the EU exit transition period on the 31st of December 2020 were automatically added to the GB Article 95 List. Suppliers who wished to remain on the GB Article 95 List after the 31st of December 2022, had to resubmit their data or a letter of access to the Health and Safety Executive (HSE) and confirm to the HSE that they (or their representative) were established in the UK. Suppliers that failed to submit the above information to the HSE will be removed from the GB Article 95 List on the 3rd of March 2025. The suppliers that are due to be removed from the list can be found on this supplementary list. 

If you are one of the suppliers listed on the supplementary list and you wish to remain on the GB Article 95 list, you should provide the following information to the HSE: 

• Confirmation of being established in the UK (GB & Northern Ireland) 

• Resubmission of data dossier or Letter of Access to a relevant data dossier 

If you have submitted the relevant information but have been included on the list pending removal, please contact the HSE. 

If you forgot to apply, there was an extended deadline to notify the HSE of intention to submit by the 1st of November 2024.  

If you are a GB biocidal product supplier, check if your active substance supplier is going to be removed from the GB Article 95 List. If you find out that this is the case, check with your supplier that actions are being taken for them to remain on the list. You can check the status of all suppliers for the active substance you use regularly on the GB Article 95 List. Moreover, you could also consider changing to a compliant active substance supplier or apply to get on the GB Article 95 List yourself if you think that your supplier may be removed from the list. If you change supplier, you may need to inform the HSE. If your active substance supplier is removed from the GB Article 95 List and an alternative source cannot be found, a grace period of 180 days may be granted for making the product available.
