Since the introduction of the EU Biocidal Product Regulation (EU) No 528/2012 (BPR), several consortia have been set up between manufacturers of active substances or biocidal product formulators to submit joint dossiers for biocidal product authorisations. We assist clients in forming consortia and in joining existing consortia, and represent our clients interests if required.
Some concepts adopted in the BPR such as the biocidal product family (BPF) or the same biocidal product (SBP) were introduced to help Small and Medium Sized Enterprises (SMEs) to reduce costs and administration issues for both applicants and regulators. The setting up of consortia facilitates companies to get the full benefits available to BPFs and SBPs in this regard.
There are no strict rules to setting up a consortium, unless the consortium is a legal entity, in which case it is important to comply with the national legislation. ECHA has produced a practical guide for those interested in setting up consortia, which can be found on its website.
If you are interested in joining with other parties to prepare an application for common active substances and product types under the BPR, Kerona Scientific would be happy to assist you in setting up a consortium or facilitate you in joining an established body. We can advise you on important issues such as data sharing, possible costs involved, and competition law compliance. Non disclosure agreements will be set up in advance with all parties.
